This document was found on the earliest roll of microfilm for Wills in New Castle Delaware at the Delaware Hall of Records, Dover, Delaware.  I neglected to write down the microfilm roll name and number.  I have tried to copy the document as written, there was a handwritten copy as well as a typed copy that had been transcribed.  This was the earliest Cartwright document found on the roll of microfilm.  Posted by Peggy Miller, October 1999.

To Jane Cartwright Relict of Thomas Cartwright late of the sd County
deced Yeom Greeting Whereas Thomas Cartwright late of the County aforesaid Yeom
Dyed Intestate (as is affirmed)  We desireing that the Goods Rights & Creditts which were of the sd decedts may be well and truly administred and Converted and Disposed of to Pious Uses Doe by Virture of the Authority aforesd Grant unto the sd Jane Cartwright in whose fidelity in this behalfe we very much Confide full power by the tenor of these presents to administer the Goods & Chattles Rights and Creditts which were of the sd decedt within this Government and faithfully to dispose thereof as also to Collect Ask Levy recover and receive the Creditts whatsoever of the said decedt within this Government which at the time of his death were owing or to him did any way belong and to pay the debts in which the said decedt Stood Obliged as far forth as the Goods Chattles and Creditts of the said decedt will Extend according to their Rate or order of Law Especially of well and truly administring the same and making a full and perfect Inventory and Conscionable appreaisment of all and Singular the Goods chattles and Creditts of the sd Decedt and Exhibitting the same unto the Registers Office att New Castle att or before the twentieth day of July next Ensuing and of rendring upon your
Oath and Solemne Affirmation a full and true acct of the said administration att or before the twentieth day of March then next following and we doe by these presents Ordaine Constitute and Depute you the said Jane Cartwright Administratrix of all and Singular the Goods Chattles and Creditts of the sd decedt within the limitts aforesaid saveing harmlesse & for ever Indempnifying the said Leiut Governor our Selves and all other Officers against all other persons by reason of your administration aforesaid and saveing to all others their Rights in Testimony whereof we have affixed the Seale of the said office to these presents dated at New Castle this twentieth day of Aprill in the Seventh Yeare of the Reigne of Queen Anne over Great britaine Anno Domi 1708

In the Name off God Amen I Abraham Cartwright the son of Thomas Cartwright of Christeen Creeck in the County of New Castle Uppon Late deceased I being of the age of Nineteen years & Eleven months I being at this present Sick of body butt of perfect Seinee mind & memory thanks be unto God therefore Calling to minde the uncertainty of this Life & well Knowing that all men are boarn to Dye doo make this my last will & Testament in manner & fourm following - First & principally I recomend my Soul into the hand of God that gave itt me Firmly believing that I shall through the merritts of my Blessed Saviour Receive further Forgiveness & Remission of all my Sins & my Body I doe Recomend Unto the Earth to be decently Buryed at the discretion of my Executor hereafter mentioned Express, & as touching all the part or Share that properly belong unto me of my abovesd Fathers Estate Both real & Personall I give and Bequeath as Followeth - Item I will & it is my will that after my Funerall charges & the probate of this my Last will & Testament & all Such debts as in Right of Conscience are any ways Due from me be duly paid and Discharged - Item I Give and Bequeath all my Share or portion that in Right of Law Unto me doth belong of my abovesd Fathers Estate Both Real & Personal Unto my beloved Brother in Law Cornelius Williams his heirs and Assigns for ever - Item I Nominate & appoint my abovesd Brother in Law Cornelius Williams to be my whole and Sole Executor of this my Last will & Testament disanulling Disallowing & revoking all former Wills by me heartofore made Either in words or writing & Ratifieing Confirming & allowing this to be my Last will & Testament & non other.

In the name of God Amen I Jacob Cartwrite of Appoquinmink Hundred New Castle County on Delaware Farmer being of Low entake of Body but of sound Disproving mind and Memory thanks be to god for the Same and knowing the incertainty of human Life do make and constitute this my last will and Testament in manner and form as follows first of all I bequeat my Soul to god who gave it in full hopes of pardon of all my sins through the merits of Christ my Saviour and my Body to the Earth to be interd in a Decent manner at the Desecession of my Executors here after named and also the worldly estate wherewith it hath pleased god to bless me I dispense of the same as follows - Item first of all I give to my beloved Sons Joseph Cartwrite & Stephen Cartwrite & Jacob Cartwrite all my Lands goods and Chattles Except bed that my Beloved Wife Lies on; to them their Heirs and assigns for ever to be Equally Divided when my beloved Son Joseph Cartwrite come of Age, - Item I give and bequeath to my Beloved Wife Mary Cartwrite The third part of all the afore said Lands and Chattles During her natural Life and likewise the Bed that was Excepted and I also Constitute and ordain my beloved wife Mary Cartwrite and Abraham Cartwrite to be my whole and sole Executors of this my last will and Testament by me here to fore made Constituted and appointed and I do hereby declare this to be my last will and Testament given under my hand and Seal this twenty fifth day of October in the year of our Lord one thousand Seven Hundred and Eighty Nine 1789

Personally appeared Benjamin Crouch, one of the subscribing Evidences to the within Will, who being Solemnly Sworn saith that he did see and hear Jacob Cartwright Sign, Seal, Publish, Pronounce and Declare the within Instrument of Writing as his last Will and Testament; that at the time of so doing and saying he was to the best of his belief of sound and disposing mind and memory, that he did sign his name as an evidence thereunto, at his request, in his presence, and in the presence of William Larrance whom he see Sign as one other evidence at the same time. In Testimony whereof I have hereunto set my Hand, at New Castle, December 10, 1709

Sir, I do hereby resign the Executership of the Estate of Jacob Cartwright deceased, in whose will I am appointed and constituted as one of the Executors therof.

Know all Men by these Presents, that we, Mary Cartwright and James Welden of Appoquinimink Hundred and of the County of New Castle, are held and firmly bound unto the Delaware State, in the sum of One Thousand Pounds? current Money of the said State; unto which payment well and truly to be made, We bind ourselves, our Heirs, Executor's and Administrators firmly by these presents. Sealed with our Seals and dated at New Castle, in New Castle County aforesaid, this tenth Day of December in the Year of our Lord one thousand seven hundred and eighty nine.

The Condition of this Obligation is such that if the within bounden Mary Cartwright (Abraham Cartwright having renounced) Executrix of the last Will and Testament of Jacob Cartwright late of New Castle County, deceased, do make or cause to be made a true and perfect Inventory of all, and singular the Goods, Chattels and Credits of the said deceased, which have or shall come to the Hands, Possession or Knowledge of the said Mary or unto the Hands or Possession of any other Person or Persons for his and the same so made do exhibit, or cause to be exhibited, into the Register's Office of New Castle County aforesaid, at or before tenth day of June next, and the same Goods, Chattels and Credits, and all other the Goods, Chattel and Credits of the said deceased at the time of his Death, which shall at any time after come to the Hands or Possession of the said Mary or into the hand and Possession of any other Person or Persons for her do well and truly administer according to Law, viz. shall pay the debts of the said deceased, so far forth, as the said Goods, Chattels and Credits will extend, and the Law will charge and do make or cause, to be made a true and just account of her Administration at or before the tenth Day of December next, and all the Rest and Residue of the said Goods, Chattels and Credits which shall be found remaining upon the said Executrix's Account, the same being first examined, adjusted and allowed of by the Orphans Court of New Castle County aforesaid, do distribute or dispose of according to Law, and true intent and meaning of the last Will and Testament of the said deceased, then this Obligation to be void and of none effect, else to remain in full force and virtue.

Newcastle County The State of Delaware, to the sheriff of Newcastle county, greeting: It is commanded you that you cite Mary Cartwright late of your county, executrix of the last will and testament of Jacob Cartwright late of the same county deceased, to be and appear before the Register of the said county, at Newcastle, on the first monday in August next, then and there to answer the complaint of Joseph Cartright one of the children of the said Jacob Cartright but more especially to show cause why she hath not made a true inventory and consiconable appraisement of the estate of the said deceased, and exhibited the same together with an account of her administration to the Register of the said county, and further to do and receive what to the said Register in that behalf shall seem meet and have you then there this w___. Given under the hand & seal of office of the Register at Newcastle, the thirteenth day of June in the year of our Lord one thousand seven hundred & ninety.

An Inventory of the Goods and Chattles of Jacob Cartwright late of Appoq.L Hundred in the County of Newcastle Del. with an apprisment made by us the Subscribes December 30th 1789. The total value of the estate was listed as $288.69 and the inventory was signed by Jacob VanDyke.

I do certify that Jacob VanDike the Living Aperaisor that he with the assistance of John Craford now deceased hath made a just inventory of the goods and chattles of Jacob Cartwright Dec. Sworn May 8, 1790 before me Wm. __?

 

The account of Mary Cartwright executrix of the last name and last wife of Jacob Cartwright late of Appoquimimink Hundred in the County of Newcastle, husbandm.an. deceased, as well of and for such and so much of the goods and chattles rights and credits of the said deceased as came to the hands of the said ecutrix as of and for her payments and disbursements there out. This is difficult to read, will do my best to transcribe the names, will leave off the dollar amounts.
This accountant craveth allowance for the following payments and disbursements by her made wit; To

This accountant craveth allowance for a bed bequeathed to her by the testator and appraised as appears by the inventory
13. This accountant's own acct. proved, for boarding & clothing Dan Booth, an illegitimate child of the said testator, for the maintenance of whom the testator had given bond and also kept the same child till his the said testator's death, the child being then about the age of four years, two years at $10.00.
Allowance to the executrix for her care and trouble $15.00
The total estate came to $332.46, Mary Cartwright signed the document, it was examined, adjusted and passed this 19th July 1796.

In the Name of God, Amon.  I Isaac Cartwright of New Castle County & State of Delaware, being sick and weak of body, though of sound and perfect mind and memory, thanks be to god, but calling to mind the mortality of my body...  Do make this my last Will and Testament as Follows to wite ---  First, I commend my soul to allmighty god who gave it....  Secondly, my body to be deacently intor, at the Diverstion of those whom I shall hereafter appoint Extr, of this my Last will and Testament,,  And as for what wordly goods it hath been fit as for god to bless me with it is my desire they shall be devided in mannor and form Following to wit---  First that all my just debts and funeral charges be paid and discharged,,  Item I give and Bequeath to Ann Booth the several articles as follows, to witt, Two Pewter dishes and Pewter Bason ten Pewter (plates?) one Round Tea Table a Linnen (spinning)wheel & cloth wool one Iron Kittle, (one Wooden wheel?) one frying pan five Knives and forks one Pair flat irons one Water pail the whole of my meat and Lard,, Six Chairs  one pot Wrack one Cupboard and Washing Tubb one pair fire tongs one Breeding Sow and three other Hoggs, her first choice with all my flax. Item I give and bequeath to John Booth (son of Ann Booth) one Bed Bedsted and Furniture Likewise it is my desire that my cow and colt may be sold and the money put to use for the above John Booth till he shall arive at the age of twenty one years and in case he should die Before he arrives to twenty one years, what I have Bequeathed to him to be the Property of his (Mother Ann Booth) and in case there should be a balance left, to be Equily divided Between my own to Sons, and Step Son Benedict by Abraham Cartwright Jacob Cartwright & Benedict Jones  And lastly I appoint and Constitute my Step son Benedict Jones Executor of this my last will and Testament... and by these Presents Revoke and Disanull all other will or wills by me heretofore made  In Witness of whereof I have hereunto set my hand and Seal this Second day of February 1789

Personally appeard Joseph Hutchison, John Hutchison and Benjamin Bensen Gears the Subscribing evidnces to the aforegoing Will, who being Solemnly Sworn, say, that they did see and hear Isaac Cartwright Sign, Seal, publish, Pronounce and declare the foregoing Instrument of writing as his last will and Testament, that at the time of so doing and saying he was (to the best of their belief) of sound and disposing mind and memory, that they did sign their names as evidences thereunto, at his request, in his presence and in the presence of each other.  In Testimony whereof I have hereunto set my Hand,
