WILL OF JACOB CARTRIGHT 1866

I Jacob Cartright of Monongalia County West Virginia, being of sound mind do make this my last will in manner and form as follows:
First I give to my WIFE REBECCA for and during her life my home farm consisting of 175 acres together with all the house hold and kitchen furniture and all money and other effects not hereafter disposed of
Secondly after the death of my wife the land to be equally divided between my FOUR DAUGHTERS and my GRANDSON GEO. W. DOLITTLE SON OF MY DAUGHTER SARAH ANN, now dead, and I also give to him a bedstead bed and bedding.
All the money's and personal effects that I have given to my wife at her death are to be divided between my FOUR DAUGHTERS CLARISSA wife of James Robe, ELIZABETH wife of Eugenius Stansbury/Stansberry?, REBECCA wife of John H. Bims?, PERMELIA wife of Thomas McBee and my GRANDSON GEO. W. DOLITTLE
ELIZABETH to have $330. more than the other four the part given to ELIZABETH to be hers during her natural life then to be equally divided between her children.
If my GRANDSON GEO. W. DOLITTLE should die leaving neither wife or children the part of my estate given to him is in that case to be equally divided between my FOUR DAUGHTERS or their children.
The 135_ acres of land that I have on Bufallo Creek in Marion County I give to NANCY WIFE OF MY SON THORNTON CARTRIGHT during her life then to her children subject to the payment of $850 (eight hundred & fifty) with interest on the same from this date if the $850. and its interest charged against the land I here will to the WIFE of my SON THORNTON & her children should not be paid to me during my life it is to be collected by my executor and by him equally divided between my FOUR DAUGHTERS & MY GRANDSON GEO. W. DOLITTLE. It is my desire that my GRANDSON GEO. W. DOLITTLE shall have a good education. I have heretofore provided for my SON JOHN C. D. CARTRIGHT by deeding him 150 acres of my home farm.
Lastly I constitute and hereby appoint my FRIEND JAMES EVANS MY EXECUTOR August 18 1866

In the Office of the Recorder of Monongalia County on Wednesday the
10th day of July A.D. 1867.
The last will and testament of Jacob Cartright deceased was this day produced to the Recorder fully proved by the Oaths and examination of James Evans and Delia E. Evans subscribing witnesses thereto and ordered to be admitted to Record.

LAST WILL AND TESTAMENT

I, W. S. Cartwright, of Monongalia County, West Virginia, being of sound mind and disposing memory, do hereby make, publish and declare this to be my last will and testament, hereby revoking any and all wills by me heretofore made.
First: I direct that al my just debts and funeral expenses be paid at my death.
Second: I give, devise and bequeath unto my beloved wife, Mahala Cartwright, of said County and State, for and during her natural life, in case she shall survive me, all my interest in the farm on which I now reside, and which farm is now owned jointly by my said wife and myself, and is known as the "Home Farm", and is situate in Union District, Monongalia County, West Virginia, and together therewith all my interest in all and everything on said farm, and at the death of my said wife, all my interest in said farm and everything thereon, except the furniture in the parlor of the residence on said farm, to go to and be divided equally between my two beloved sons, William A. Cartwright and Charles H. Cartwright, share and share alike, and the furniture in the parlor of the residence on said farm to go to and belong to my beloved granddaughter, Florence Daffney Cartwright.
Third: All of the money of which I die seized and possessed I give, devise and bequeath unto my beloved wife, said Mahala Cartwright, to do with as she pleases for and during her natural life, and at her death, whatever sum may be left, if any, to be equally divided between my beloved daughters, Gertrude Males and Ida Poundstone, and my beloved son, James A. Cartwright, share and share alike.
In Witness whereof I hereunto subscribe my name and affix my seal, to this, my last will and testament, in Monongalia County, West Virginia, on this the 15th day of June, 1921.

The above signature of the testator, W. S. Cartwright, was made, and the foregoing will acknowledged by the said W. S. Cartwright, in the presence of us, two competent witnesses present at the same time; and we, the said subscribing witnesses, do hereby and hereunto subscribe our names to the said will in the presence of the said testator, W. S. Cartwright, and in the presence of each other, at the special instance and request of the said testator, W. S. Cartwright, this the 15th day of June, 1921.

In the office of the clerk of the County Court of Monongalia County, West Virginia, in vacation of the Court on
TUESDAY, JANUARY 20, 1931.
WILL OF W. S. CARTWRIGHT
This day before me John M. Gregg, Clerk of the County Court of Monongalia County, West Virginia, in the Clerk's office in vacation of the Court came Charles T. Herd and produced satisfactory proof that W. S. Cartwright died in the said county on the 25th day of November, 1930, and that he was at the time of his death a resident of the said county and the owner of real and personal property therein. And the said Charles T. Herd presented a writing dated the 15th day of June, 1921, purporting to be the last will and testament of the said W. S. Cartwright, deceased, and offered the same for probate and record.
Whereupon, came A. L. Hartley one of the attesting witnesses to the said writing who after being first duly sworn upon his oath states: That he was present at the time of the execution of the said writing and saw the testator sign his name thereto; that the said W. S. Cartwright signed and acknowledged the said writing as and for his last will and testament in the presence of the said A. L. Hartley and D. K. Marchand the other attesting witness thereto: That they the said witnesses at the request of the testator in his presence and in the presence of each other signed the said writing as witnesses thereto; that at the time of the execution of the said writing the said W. S. Cartwright was of sound mind and memory and was over the age of twenty one years.
And it appearing that the said D. K. Marchand, one of the attesting witnesses to the said writing is a resident of Dormont, Pittsburgh, Pennsylvania, and that his deposition is necessary to the proper proof of the said writing; it is therefore ordered that the deposition of the said D. K. Marchand as to the execution of the said writing be taken in Dormont, Pittsburgh, Pennsylvania, or wherever he may be found, before some officer of the law duly authorized to take and certify Depositions, and that when so taken and certified that such deposition shall be returned to and filed by the Clerk of the County Court of Monongalia County, West Virginia, in his office in the manner provided by law.
And it is further ordered that for the purpose of such deposition the Clerk of this Court shall transmit to the said D. K. Marchand to his last known Post Office address by registered mail, or by some other safe mode of conveyance, the said original writing together with a copy of this order. But before so doing he shall retain a true copy of the said writing in his office.
